Preamble

The purpose of the present document is to define the terms and conditions under which the development team of the CryptPad software, hereinafter referred to as "the Publisher", makes the website and the services available on the website available to its Users, as well as the manner in which the User accesses the website and uses its services.

Any connection to the website is subject to compliance with these conditions.

For the User, simple access to the CryptPad.fr website at the following URL address https://cryptpad.fr, hereinafter referred to as the website, implies acceptance of all the conditions described hereinafter.

CryptPad.fr is administered by the CryptPad open-source software development team. The team provides "Premium" accounts as a commercial service to support the maintenance and ongoing development of CryptPad. Public access to the Website is provided on a voluntary basis and is revocable at any time.

Presentation of the CryptPad Solution

CryptPad is an "Office" solution offering a range of tools for collaborative work: text editor, spreadsheet, code/markdown editor, kanban table, form, drawing table or markdown presentation creator.

All data on the website is encrypted in the browser. This means that no readable or decryptable data leaves the User's device. Furthermore, the Publisher's administrators have no access to document content or User data.

CryptPad is built to enable collaboration. To this end, the solution is synchronized to enable multiple Users to edit documents in real time. As data is encrypted, the Publisher and his or her administrators have no way of seeing the content being edited and saved.

CryptPad is free software. Anyone can host the platform on a personal or professional scale. The development team offers subscriptions and support contracts for out-of-the-box deployment. More information on CryptPad and its features can be found at: https://cryptpad.org/about/

All elements of this website, including downloadable documents, are free of copyright. With the exception of iconography, the reproduction of pages from this website is authorized on condition that the source is mentioned. They may not be used for commercial or advertising purposes.

Rights and Obligations

Of the User

The Website enables the User to work collaboratively on the same suite of productivity tools. The User is free to share their documents if they wish. The Publisher cannot be held responsible if these documents are shared via unsecured communication channels and/or with the wrong people. The User is solely responsible for the proper sharing of their documents.

Users under 13 years of age may only use the Website with the consent of a legal guardian.

The User undertakes not to attempt to breach the data usage restriction by creating multiple accounts. Administrators reserve the right to delete content and disable accounts that appear to be acting in this way.

Should the User come across content in breach of these Terms of Use, they may report it via the support form or by contacting the editor.

Moreover, by accepting these Terms of Use, the user agrees not to:

  • publish racist, xenophobic, homophobic, transphobic, ableist or classist content;
  • infringe the rights of a third party, for example through harassment, invasion of privacy, threats, defamation and/or slander;
  • publish content promoting real-world physical and/or sexual abuse;
  • publish content aimed at misinformation and/or disinformation;
  • publish hate speech;
  • publish content that is the intellectual property of a third party without their consent;
  • publish content intended to promote fraudulent practices and/or scams.

More generally, the User agrees to comply with current French legislation and with legislation in force in the country where the user uses the Website.

The Publisher reserves the right to suspend any account associated with the above-mentioned prohibited practices, at its own discretion, without prior notice or warning.

Of the Publisher

The information and/or documents appearing on this website and/or accessible via this website come from sources considered to be reliable. However, such information and/or documents may contain technical inaccuracies or typographical errors. The Publisher reserves the right to correct such errors as soon as they are brought to its attention.

It is strongly recommended that you check the accuracy and relevance of the information and/or documents made available on this website.

The information and/or documents available on this website may be modified at any time, and may have been updated. In particular, they may have been updated between the time they were downloaded and the time the User took cognizance of them.

The Publisher reserves the right to modify these conditions of use at any time and without notice, in order to adapt them to changes in the website and/or its operation.

Data retention

While CryptPad.fr can be accessed for free and doesn't require an account, the Publisher reserves the right to remove content after a period of inactivity.

It is the responsibility of the User to ensure the safety of their data. The Publisher cannot be held responsible in case of data loss.

The website may contain hypertext links to other websites on the Internet. Links to these other resources will cause you to leave the website.

It is possible to create a link to the presentation page of this website without the express authorization of the Publisher. No authorization or request for prior information may be required by the Publisher in respect of a website wishing to establish a link to the Publisher's site. However, it is advisable to display this website in a new browser window. However, the Publisher reserves the right to request the removal of any link it deems to be inconsistent with the purpose of the website.

Interaction with law enforcement

CryptPad.fr is hosted in France by XWiki SAS and is subject to French law. We may be approached by members of law enforcement requesting information about users of the service.

Under normal circumstances we will only cooperate to the minimum extent which is required by a court order or judicial requisition. Under these conditions we may be obliged to share the limited data that is available on our servers.

In extreme cases where clear harm is being done by users of the website (e.g. terrorism, human trafficking, hate crimes) we may choose to cooperate with law enforcement more proactively at our discretion.

Force Majeure - Hardship

The Publisher may not be held liable if the non-performance or delay in performance of any of its obligations described in these Terms of Use is due to force majeure. Force majeure is defined as any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code.

Applicable Law

The present Terms of Use and all operations arising therefrom are governed by and subject to all applicable French law.

In the event of any dispute relating to the interpretation and execution of these Terms of Use and all operations arising therefrom, the Parties agree to settle the dispute amicably in the first instance.

Only the French version of these Terms of Use is legally binding. Any translation is provided for information purposes only and shall have no legal effect whatsoever. Any dispute which cannot be settled amicably will be subject to the jurisdiction of the Paris courts.
